My boyfreind upgraded a time share at Westgate Resort. The contract states that he will mail payments in on the 10 of the month. He did not make his first payment because they withdrew money on the 3 which caused checks to bounce. After calling the Resort, they said he signed for an amount to be taken out on the 3. Chris, asked them to send a copy of the signed doccument. They didn't. He is now wanting out of the contract because he believe it is fraud. Is this possible now?

No, it is not possible. They have your signatures and your okay to take automatic withdrawals from your bank account with the number that you provided.

Even if you feel it was unethical... no matter what the reason... They have your signature. They have you. I had to learn this the hard way... attorney fees, the whole 9 yards, with Capital Merchant Services. Same type of scenario -I too had to request copies ~ they tell you one thing to get your signature and fill in their own details depending on how generous they're feeling that day (towards themselves). And its all perfectly legal. Chalk another one up for de-regulation.

Your best, and unfortunately, only, option is to negotiate a lump-sum payoff for a reduced rate than it would be if paid over time. And pray the tide will turn and hope for a class action suit.
