I don't know about America, but here in England, one young man stopped his girlfriend from having an abortion saying he had equal rights to the child since he was the father.
He won.

That is a question that only an attorney where you live could answer. My understanding is that you can try to sue anyone for anything, so it's not a matter of filing a lawsuit but rather what precedents have been set that would lead you to think you might be successful. I'm assuming that the abortion has already happened so I'm wondering what your purpose in sueing her is? You can't prevent the abortion at this point so are you looking for revenge? easy money? trying to punish her? Make sure you understand your motivation before setting something like this in motion.
