ok i was at my house where i have been drinking. i got into a demestic despute with my mother.short story ithe cops came cuffed me went to put me in the car and then i just tryed to speek with my mom right befor the put me in the car. the police oficer then spun me around slamed me to the ground and taserered me about 5 time while i am still in cuffs. now would that be consederd excessive force or no. just wanted to know sence i was cuffed and did not post any kind of threat
we might think so, however, you probly should have just got in and NOT tried to talk to your mom, they told you to get in the car, and you did not do "exactly" that, and when you tried to talk to her the cop can say you did not do what he said and found couse to taze you, wether you were in cuffs or not, many people are tased while in cuffs, it makes no difference, and the fact you were drinkin' is not helping your case either, becouse it is your story (drunk) against his, and i bet he wins that fight, unless it is on camera, i really doubt you will win this fight, unfortunatly, but if it is on tape, i would contact an attorney, and have them request a copy of the video tape, becouse realy only an attorney can answer this question with 100% certanty, might cost a buck or two, but if he agrees with you, it might be worth it!!! police are human, we do respect them for them doing their job, however, we all (including them) make mistakes, and in many cases it has been proven! so good luck hope this helps
I agree with Todd. No matter how badly you felt, you did the oppisite of what you should have done. You may speak to a lawyer about this, if you feel it was excessive, but it's likely a lawsuit would go nowhere. My biggest thing is, don't drink. Drinking harms you AND people around you. It causes you to do things that hurt others. Please Do think abiout that. Thank you.
