property right of way

i bought a piece of property 9 years ago. I agreed to give the previous owner right of way to tap maple trees for syrup. Now he is very old, has not tapped trees in three years. Now he wants to remove and sell the vaporater that is bolted down out of the sap house. Does he have a right to do so?

the sap house has been there 100 years and the equipment was in there when i bought the property and i also live on the property.

it is a writen agreement that he had right of way to sap the trees. Also that he could NOT transfer his rights to anyone. also i have no tresspassing sign up and he has been bringing people in to look at the equipment.

Do you own the equipment and he was just using the resources, or did he install the facilities?

How exactly did you "agree", was it in writing or verbal? Regardless, if you own the property and the equipment and all you did was verbally agree to allow the man to use your equipment to extract some sap, then he has no ownership of it of any kind.

Well I think you are well within your rights, I would contact a lawyer and get a restraining order to keep him from the property and a cease and desist order to stop any attempts to sale said property.

You could try speaking with him directly, but if that isn't something you want to do use the law that is what it is there for.
